The MPs who were expelled from the NRM party in April last year went to the Supreme Court seeking an interim order to stay the execution of the orders of the constitutional court which on Feb 21 ruled that the MPs should vacate their seats in parliament since they were no longer members of the party upon whose ticket they were elected to parliament.
 
The ruling which was delivered by Justice John Wilson Tsekoko stated that the rationale of an interim order is to maintain the statuesque while the applicants exercise their right of appeal.
 
Tsekoko said that the court in its discretion to make orders to achieve the ends of justice here by grant an interim order and an interim injunction restraining the Speaker, the Deputy Speaker and the Electoral Commission from implementing constitutional court orders.
 
Tsekoko added that the application for an interim order had not been overtaken by events like the respondents argued saying that the orders have not been fully implemented.
 
Lawyers representing the NRM party and the Attorney General had earlier argued that there is no execution to stay since the court orders had already been adhered to by the Speaker of parliament, the Clerk and the Electoral Commission.
 
The electoral commission earlier today announced April 17 as the day to hold by-elections in the constituencies of Buyaga, Ndorwa East, Lwemiyaga and Kampala Central.
 
One of the lawyers of the NRM party Severino Twinobusingye said that they respect the court’s decision. Twinobusingye said that since the Supreme Court is the highest court of the land, it has cancelled all the decisions of the other courts and that they have no choice but to prepare themselves for the main case.
 
Peter Walubiri, the MPs’ lead counsel said that it is good the Supreme Court has understood the matter better adding that he is hopeful the court will sort out the issues that the Constitutional court didn’t.
The other Judges on the bench were Benjamin Odoki, Esther Kisakye, Christine Kitumba and Galdino Okello.
