The High Court sitting in Kasese on Tuesday sentenced a 25-year-old man to 15 years in jail after he pleaded guilty to aggravated defilement charges.

Joseph Thembo, a resident of Kitabu village, Kyalhumba sub-county, is the only one of the thirty suspects facing criminal trial to plead guilty at the special High Court session presided over by the Fort
Portal Resident Judge Justice Dan Akiiki Kiiza.

The one-month special session will hear 30 criminal cases that have been a backlog dating back to 2011.

Thembo told court that on May 22, 2011 while at Kitabu village he defiled a six year-old girl, a daughter of his neighbor.

Court heard that Thembo lured the girl to go to his house where he immediately defiled her. The matter was reported to police by the victim’s mother after realizing that she was bleeding. State prosecutor Noah Kumya told court to give a maximum sentence of death to scare away other men involved in the vice.

Kumya said that Kasese district has rampant cases of aggravated defilement which commands 18 of the thirty cases before the judge in this month’s session.

But the accused through his lawyer, Solomon Orone of the Uganda Christians Lawyers Fraternity, prayed for a lenient punishment because he is an orphan and also taking care of his deceased brother’s children.

In his ruling, Justice Kiiza said the accused did not waste court’s time and was a first offender, but his actions are a threat to the lives of young girls in the society.

Justice Kiiza said the accused should have treated the girl as his daughter but instead defiled and inflicted pain on her. He sentenced him to 15 years in jail.

Aggravated defilement upon conviction carries a death penalty or a sentence of between 10 to 35 years.
