Magistrate Orders Police to Investigate 4GC Claims

Justine Atukwasa, the Nabweru chief magistrate has given Police 14 days to investigate allegations made 4GC activists against some senior police officers. Atukwasa issued the directive on Monday in response to an application filed by 4GC activists asking court to issue criminal summons against the officers. The implicated cops include Kale Kaihura, the Inspector General of Police, Felix Kaweesi, the commandant Metropolitan police, Micheal Mugabi, the Regional police commander Kampala South, Siraj Bakaleke, the DPC Kawempe, Gobolo Julius and Sam Omara, the Kampala Metropolitan Police Operations Commander.

In her 25th March letter, Atukwasa directs Grace Akullo, the Director of the Criminal Investigations Directorate to carry out our further investigations into the matter. Atukwasa wants to establish who the hooligans referred to in the 4GC complaints are, the officers who were at the scene and the roles of the accused. 
                                                                                                                                                
She also wants police to investigate who damaged the vehicles mentioned in the suit; those behind the assault and any other information to enable court proceed with the issuance of summons and trial on the matter. But Erias Lukwago, the Lord Mayor says that they expected the magistrate to issue criminal summons against the accused in compliance with the law instead of asking police to investigate the case. He says that while the court proceedings are ongoing, they are also going to take the matter to the Principal Judge to get a fair hearing since they do not expect Akullo to investigate the IGP.

Dr Kiiza Besigye says what they are dealing with is an exposure of impunity where people commit offences and get away scot free as long as their actions are in support of the regime. He argues that court should have tested the evidence and see whether it is valid or not.

The activists add that this case is supposed to show the impunity in the justice system so that it lays a formal ground for them to turn to the International Criminal Court in The Hague. On the charge of conspiracy to commit a felony the activist state that the above named police officers willingly and unlawfully conspired to cause injuries to the persons of Lord Mayor, his deputy Sulaiman Kidandala, Ssemuju Nganda, the MP Kyadondo East and Col. Retired Dr. Besigye among others.

They claim that on 1st March 2013 at 1:00pm in Kawempe the officer also attacked and injured Nakato Nusifa, Kato Fred, Councilor Shafiq Kolo and Isma Mawejje. On the same date the also allegedly damaged the rear glass, windscreen and two side glasses of a Toyota Land Cruiser UAN 661V belonging to Dr Besigye, Prado reg UAR 454D belonging MP Ssemuju and the side Mirror of a Toyota Prado reg. Number UAQ 186D belonging to Kidandala
