Motor rally ace Ponsiano Lwakataka returns to Court today as he awaits a decision on his bail application.

Kalisizo grade one magistrate Suzan Awidi is expected to determine whether Lwakataka, 42, and his co accused Abdallah Mukiibi deserve bail. They are both accused of interfering with police work and assaulting a police officer among other charges.

Prosecution alleges that Lwakataka on 3rd March 2013, while at Kanyanoti village in Kyeebe Sub County in Rakai District interfered with the work of a police Constable (PC) Mikidaadi Kabiito, during an operation to impound immature fish.

Prosecution led by Miriam Akite further alleges that Abdallah Mukiibi, Lwakataka’s co accused on the same day, assaulted a Police Officer, caused grievous harm and interfered with his duty. The duo denies the charges. They are also accused of obstruction of an officer on duty, threatening violence and conspiracy to prevent an officer on duty from apprehending suspects who had immature fish.

It is reportedly said that Kabiito lost three front teeth.  The officer also sustained serious bodily harm in the scuffle. The Constable No.4347 was rushed to hospital for medication.

They were remanded last week, Thursday after the trial Magistrate asked defense Lawyer Hassan Kamba to present his Practicing Certificate before court. He failed to retrieve it off his computer when asked to do so last week due to power outages.

Meanwhile, Our Reporter in Kalisizo reports that armed prison warders and plain clothed detectives have cordoned off the area near the court cell, to bar people from accessing the accused before court proceedings.
