Kisiizi Hospital Management Summoned over Death of New Born

The Assistant Registrar of the High Court at Kabale, Her Worship Mary Babirye has summoned the Board of Governors of Kisiizi Hospital to file in their defense after the Voice of Kigezi FM News anchor and Editor Ms Jackline Tumuheirwe, sued the hospital for alleged negligence that led to the loss of her new born baby.
 
Kisiizi Hospital board is required to file a defence within fifteen days from the date of service of summons on it in the manner prescribed under Civil Procedure (Amendment) Rules. The summons were issued on December 02.
 
Through her Lawyers of M/S Murumba and Matsiko Advocates, Tumuheirwe issued an intention to sue the Hospital on 24th September this year.
 
The notice indicates that she was admitted at Kisiizi hospital on 3rd September this year and discharged on 10th September this year.
 
It also indicates that Tumuheirwe had a week earlier come to the hospital after attaining 40 weeks to ensure safe delivery but was advised to report back on 3rd September this year by a doctor at the
Hospital.
 
On 3rd September this year, she was admitted and demanded for an operation because she had on a previous occasion undergone a caesarean operation and the hospital knew this fact.
 
The notice also indicates that her demand was allegedly ignored until 6th September this year when she started discharging meconium. It is also alleged that the unborn infant inhaled the meconium fluid which led to eventual death.
 
The notice also indicates that the doctors were negligent by failing to attend promptly to the victim requiring an urgent attention when they were in a position to do so.
 
Now, in this summon, Babirye says that should the Board of Governors fail to file a defence on or before the date mentioned, the plaintiff may proceed with the suit and Judgment may be given in the Board's Absence.
 
The management of the hospital has declined to comment  on the matter.
